Across the U.S. authorities are upping their game to eliminate contractor misconduct by giving out tougher punishments for instances that used to just be filed as a warning.
Thomas Kokalas, a former prosecutor and partner with Bracewell & Giuliani, LLP told Construction Dive ways that construction companies can avoid these penalties and sentences.
One way to avoid this is by focusing on minority workers in the construction field. One aspect is on construction companies that are required to hire minority workers, while the other is on taking advantage of the U.S. Department of Transportation’s 10% earmark on contracts for DBEs. It is necessary for companies to properly follow laws regarding hiring minority workers and properly filing paperwork.
Secondly, Kokalas recommends focusing on making sure workers are safe under OSHA regulations. This is another aspect that prosecutors are going after construction companies for.
